State Medicaid programs play a pivotal role in ensuring the health and well-being of some of the most vulnerable populations in the United States. While the federal government has laid out a basic framework for how Medicaid programs must operate, states have a number of tools that allow them considerable flexibility in shaping their individual programs. One such tool is the Medicaid Section 1115 Demonstration Waiver. This web forum will take a deep dive into a new resource on Section 1115 Waivers from the Center for Health Law and Policy Innovation and the GO2 Foundation for Lung Cancer: Non-Emergency Medical Transportation and 1115 Waivers – A Toolkit.
Specifically, we will examine troubling trends in the use of Medicaid Section 1115 Demonstration Waivers to restrict access to services, with a particular focus on Non-Emergency Medical Transportation (NEMT) and work requirements. During the web forum, we will walk participants step-by-step through the Section 1115 Waiver process and identify important opportunities and strategies for responding to Waiver proposals. Additionally, we will discuss the status of recent lawsuits challenging the use of 1115 Waivers to impose work requirements and highlight a looming threat to NEMT—a potential regulatory change that would make transportation coverage optional for state Medicaid programs.
